A witness, one of the last people to see stabbing victim 47-year-old Linda Surginer Preston alive, lied to Parker County sheriff’s deputies about events involving the suspect on the day of the killing, court records released Tuesday state.
Though he is not believed to be involved in the murder, Carlos Martinez, 28, was arrested Saturday on a charge of giving a false report to a law enforcement officer, a class B misdemeanor.
Martinez, a cousin of capital murder suspect Hector Trejo, told investigators that he saw Trejo go to the residence directly across the road from where Martinez was staying Thursday.
Martinez approached Trejo and Preston, who were talking on Preston’s porch, and then went to his own residence, leaving them together, according to the probable cause affidavit filed with Justice of the Peace Kelly Green.
Trejo returned about 10 to 15 minutes later with the victim’s car keys and stated that “she wants us to go get her something,” Martinez reportedly told investigators.
The two men then left in Preston’s vehicle, according to Martinez.
When asked, Martinez vehemently denied seeing blood or cuts on Trejo, hearing Trejo mention the murder or hearing loud noises while Trejo was at Preston’s house, according to the investigator’s probable cause statement.
“Hector Trejo confessed to the murder” during an interview with investigators, according to the probable cause statement.
Trejo allegedly told investigators that he took the woman’s keys to the BMW and told Martinez, “Let’s go.”
Martinez asked if Trejo and the woman were fighting, and while on the way to Fort Worth, Trejo told Martinez that he had done something really bad and would probably go to prison for a long time, Trejo reportedly said.
Trejo, released on parole Sept. 4 after a 5-year conviction involving a 2008 home invasion, got into an argument with Preston after she refused to let him use her car. He then repeatedly stabbed and cut her neck and throat with a knife, the Parker County Sheriff’s Office alleges.
He reportedly took her gray BMW and cellphone after the slaying.
The vehicle was recovered the following day in Fort Worth and Trejo arrested on a parole warrant violation.
After reportedly confessing to investigators Friday night, Trejo was charged with capital murder and remained in the Parker County Jail without bond Tuesday.
